Notes of Proceedings in Suresh Kumar Kaushal v. Naz Foundation February 23 to March 27, 2012 Supreme Court of India

In December 2001 the Naz Foundation files a petition challenging Section 377 in Delhi High Court. The judgment of the Delhi High Court in Naz Foundation vs. Union of India was delivered on 2nd July, 2009. From there on Public Interest Litigations (PILs) filed followed before the Supreme Court against the Delhi High Court's order de-criminalizing homosexuality. There have been a wide range of concerns raised by the PILs on the consequences of the Delhi High Court's order by anti-homosexual persons and institutions. The first petitioner challenging the order was astrologer S.K. Kaushal, who sought an interim stay of the High Court's order, on the grounds that "gay parlours" and "gay prostitution" were mushrooming in the aftermath of the judgement and there were also instances of same sex marriages taking place.
