Case of P. B. and J. S. v. Austria : (Application no. 18984/02) : judgment

The applicants are P.B., a Hungarian national, and J.S., an Austrian national. They were born in 1963 and 1959 respectively and live in Vienna in a homosexual relationship. Relying on Article 8 (right to respect for private and family life), Article 14 (prohibition of discrimination) and Article 1 of Protocol No. 1 (protection of property), they complain about an Administrative Court decision of October 2001 in which it was upheld that J.S.'s insurance cover as a civil servant could only be extended to a heterosexual partner.
